Sexual Harassment Complaint Hotline Is Live
Employers should take note and understand how the hotline works
New York State now offers a sexual harassment complaint hotline for employees. Workers complaining of workplace harassment can call, and their conversation will remain confidential.
The New York State Department of Human Rights (NYSDHR) is administering the law enacted in March 2022. The law establishes:
- A toll-free confidential hotline open from 9:00 AM to 5:00 PM
- Sexual harassment counsel and assistance
- Free legal counseling for any workplace sexual harassment complaint
- Legal counseling that is free to help with submitting a complaint
- Call 1-800-HARASS-3
Staff in the NYSDHR’s Office of Sexual Harassment Issues (OSHI) will operate the hotline during regular business hours. They will provide information about how to file a sexual harassment complaint. In addition, they will provide the name and contact information of an experienced sexual harassment attorney who has provided limited pro bono assistance.
Under the new law, all NY employees, no matter where they work, receive protection under NYS sexual harassment laws. This includes: consultants, repair technicians, salespersons and delivery drivers. The harassment does not have to be severe or pervasive—all harassment is unlawful. From the date the harassment incident occurs, workers have up to three years to file a sexual harassment claim. They will file the claim with the Division of Human Rights.
What added responsibilities do employers have related to the sexual harassment complaint hotline?
Employers must include information about the hotline in any materials they provide to employees. They must also include it in posted sexual harassment information.
