New York Department of Labor Updates Minimum Wage Poster

New Posters Reflect Increases in Minimum Wage in NYC and Throughout State of New York

In May, 2023, New York Governor Kathy Hochul signed a bill into law increasing the minimum wage under state law. Effective January 1, 2024, the minimum wage increased to $16.00 per hour in New York City, and in Suffolk, Nassau and Westchester counties. The minimum wage in the rest of the state went up to $15.00 per hour. The increases apply to workers in all industries other than hospitality, farming and building services.

Under New York state labor laws, all employers are required to display a minimum wage poster in a visible location in the workplace. The New York Department of Labor customarily creates the poster and makes it available to employers. To comply with the increases in the state minimum wage, the New York DOL has issued an updated minimum wage poster, which specifically applies to what are considered “Miscellaneous Industry” workers. In addition to wages, the new laws include increases for a number of other employee benefits and reimbursements, including allowances for meals and lodging, tip credits and the maintenance of uniforms.

The minimum wage laws can apply to salaried, as well as hourly, employees, though salaried workers with income above designated thresholds are exempt from the minimum wage laws. For example, executives and administrative workers in Suffolk, Nassau and Westchester counties, and in New York City who make more than $1,200 per week are not governed by the minimum wage requirements. The same workers in other parts of the state will be exempt if their weekly income is $1,124.20.
